What is comparative negligence?

In some states, if a person injured in a car accident is at all responsible for it, he or she is not eligible for compensation. However, this is not the case for most states. New York practices a form of comparative negligence in which even those who are deemed responsible for the accident can collect damages.

According to the state policy, the amount of compensation given will be reduced according to the percentage of fault an individual is responsible for. So if you are 80% responsible for the car accident, you will only receive 20% of damages.

If you or someone you love has been the victim of a car accident, the Queens car accident lawyers of Parker Waichman, LLP may be able to get you the compensation you deserve. Contact us today by calling 888-244-2273.
